Jared Te Whare was working at the beef processing plant operated by UBP Limited (the defendant), in Te Kuiti (the plant). While on a legging stand, Mr Te Whare suffered an epileptic seizure, and fell approximately 2.3 metres to the concrete floor below. As a result of the fall, Mr Te Whare suffered serious head and chest injuries, and died.
