The defendant company, trading as Mobile Station, operates a showroom in Auckland where customers can view mobile phones before purchasing the product online from the Hong Kong branch of the company.
The chargers that were included with the mobile phones supplied by the Mobile Station did not fit New Zealand power outlets. The Mobile Station also supplied adaptor plugs with the mobile phone package for customers to use the chargers in New Zealand.
The chargers were declared a medium-risk article, which cannot be supplied or offered for supply in New Zealand without a declaration of conformity. A declaration of conformity could not be issued for the chargers in this case because they were not configured to fit New Zealand power outlets as required by the relevant regulations.
The adaptor plugs were declared a high-risk article. The adaptor plugs were not approved for supply by WorkSafe NZ as required by the relevant regulations.
The adaptor plugs were also electrically unsafe because they did not have adequate protection from contact with live parts.
