On 28 May 2013, an employee of LRK Trays Limited ("LRK") was struck by a forklift reversing past the place where she was working at a Mount Maunganui site where kiwifruit were being packaged and stored. LRK was contracted by this defendant to provide labour. The victim was an employee of a contractor to this defendant.

The victim suffered serious harm injuries; a fractured ankle and large laceration behind the knee. She had surgery on her injured ankle. Pins were inserted in it and the wound to her leg was stitched up.
