The defendant company was engaged to construct a residential home and engaged a building contractor to work at the site. On 13 May 2013, the contractor amongst other workers was erecting trusses for the construction of the garage.
The truss was heavy due to it being waterlogged. As it was being maneuvered into position by sliding it along the top plate, the apex pivoted and the truss slipped off the top plate. As the truss slipped, the contractor lost his balance and fell from the top plate to the ground.
Contractor suffered fractured wrist and jaw when he fell off the roof.
