WorkSafe has exempted Clelands Timber Ltd from compliance with regulation 11.37 of the Health and Safety at Work (Hazardous Substances) Regulations 2017.

An exemption has been granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 to Clelands Timber Ltd to provide fire rating to one wall of its timber treatment plant building in alignment with the fire rating of the other walls.

The exemption is made to vary condition 9 of an existing decision SEP1631 as follows:

9.  By 30 November 2018, Clelands Timber Ltd must:

• Locate the tank fill point outside the building at least two metres from any opening into the building (see AS1940:2004), section 5.3.2(c)) and
• Upgrade the fire rating of eastern wall of the treatment plant building to no less than -/240/60 FRR to a height of 5.1 metres.

The exemption takes effect on 30 May 2018 and expires on 30 May 2023 unless it is sooner replaced or revoked.
