Facts in brief:
The Defendant is employed by the Wearing Partnership as a Herd Manager. He owns a quad bike which he has been observed on numerous occasions by MBIE Labour Inspectors as riding a quad bike without wearing a helmet and carrying his two year old child sitting in front of him on the quad bike.

Prohibition notices were issued to the Wearing Partnership, prohibiting the carrying of passengers on quad bikes and requiring helmets to be worn on the quad bikes. There was no accident or injury in relation to this case. On 3 October 2013, two Health and Safety inspectors were driving through the Rai Valley. The defendant was observed operating a quad bike with a child on the bike and the defendant was not wearing a helmet.
