L & L Marriott Holdings Limited operates a vehicle panel beating and spray painting business.
On 14 March 2014 a WorkSafe Inspector visited the Defendant’s premises and saw a worker spray painting with fumes clearly visible. There was no method of removing the paint fumes and, furthermore, there was unsafe electrical sources present causing the risk of fire. The worker was not using an appropriate mask respiration system and another worker was seen to be walking in the area of those fumes with no protective clothing.
A prohibition notice, prohibiting all spray painting, was issued to the Defendant on 25 March 2014. The Defendant was informed that a complaint spray boot would mitigate the hazard.
The Defendant subsequently breached the prohibition notice on three occasions.
