The Defendant is the employer of the victim, who on 12 August 2013 suffered a crush injury on the index finger of his left hand when it became trapped between a pipe and upper roller of a PK30 Sahinler pipe bender machine (the Pipe Bender).

On the day of the accident, the victim was using the Pipe Bender to bend aluminium pipe. He was wearing personal protective equipment including gloves and was feeding lengths of pipe into the Pipe Bender. As the pipe went under the upper roller Mr Miller’s glove and left index finger was pulled in and crushed in the in-running nip created by the pipe and roller. As a result of the accident, Mr Miller suffered a crush injury to his index finger.
