The Defendant company (now in liquidation) was a forest harvesting company.

The victim was employed by the Defendant. On the day of the incident, the victim was operating a log skidder dragging extracted logs. During an extraction of a log, a boulder was dislodged and rolled down a hill where it collided with the skidder. The skidder rolled down the hill with the victim inside.

The victim suffered a large laceration to the top of his head, multiple facial fractures and severe nerve damage to his face.
