The Defendant company is a forestry management company who engaged B & R Logging Partnership for logging work at Tirosh Estate Limited. The Defendant company's crew were not qualified to carry out machine assisted tree felling. The victim was struck by the butt of a tree that was being felled, as he was retreating to a safe zone.
