WorkSafe has granted an exemption to L’Oreal New Zealand Limited from compliance with Regulation 11.30 of the Health and Safety at Work (Hazardous Substances) Regulations 2017 in relation to the new flammable liquids store that is attached to the distribution warehouse of Unit 8, 9 Manu Street, Favona, Auckland, that at the time this exemption was granted stored flammable aerosols.

The application to grant an exemption has been decided as follows:

The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 on the basis that WorkSafe is satisfied that—

  • the extent of the exemption is not broader than is reasonably necessary to address the matters that gave rise to the proposed exemption; and
  • the exemption is not inconsistent with the purpose of the Act.

WorkSafe note that—

  • The risks to health and safety of workers and others can be managed with the use of a high expansion foam system; and
  • The conditions enable the risks at the site to be managed for the new flammable liquids store.

The exemption comes into effect 01 October 2019 and expires on 01 October 2024 unless it is replaced sooner or revoked.
