WorkSafe has granted an exemption (HS2113) to Hiringa Energy Limited from compliance with the requirement in regulation 16.30(2) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 to comply with Chapter 6.7 of the UN Model Regulations in relation to the multiple element gas containers (MEGCs) that are to be used as transportable containers.

The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 on the basis that WorkSafe is satisfied that—

  • the extent of the exemption is not broader than is reasonably necessary to address the matters that gave rise to the proposed exemption; and
  • the exemption is not inconsistent with the purpose of the Act; and

WorkSafe is satisfied that it is appropriate to grant the exemption as Chapter 6.8 of the Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road (ADR) and EN 12245 Transportable gas cylinders provides an acceptable alternative to Chapter 6.7 of the UN Model Regulations and ISO 11515 Gas cylinders.

The exemption comes into effect 18 March 2022 and expires on 18 March 2027 unless it is replaced sooner or revoked.
